1. Enrollment Agreement: By enrolling in the Olive Oil Times Education Lab Sommelier Certification Program, you, the participant, acknowledge and agree to the terms and conditions set forth in this Liability Waiver and Release Form. Your enrollment in the program is conditioned upon your acceptance of these terms.
  2. Acknowledgment of Risks: I, the undersigned participant, acknowledge that participation in the Olive Oil Times Education Lab Sommelier Certification Program involves inherent risks and dangers, including but not limited to the risk of bodily injury, allergic reactions, and other potential hazards associated with olive oil tasting and related activities. I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, or the conditions in which the program takes place.
  3. Assumption of Risk: I willingly agree to participate in the Olive Oil Times Education Lab Sommelier Certification Program and hereby assume all risks and responsibilities surrounding my participation. I understand that Olive Oil Times LLC does not require me to participate in this activity, and I choose to do so despite the potential risks.
  4. Release and Waiver of Liability: In consideration of being allowed to participate in the Olive Oil Times Education Lab Sommelier Certification Program, I hereby release, waive, discharge, and covenant not to sue Olive Oil Times LLC, its officers, agents, servants, affiliates, employees, and volunteers (hereinafter referred to as "Releasees") from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me while participating in such activity, or while in, on, or around the premises where the activity is taking place, or while traveling to or from the premises.
  5. Indemnification: I also agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation in said activity, whether caused by negligence of the Releasees or otherwise.
  6. Acknowledgment of Understanding: I have read this waiver of liability and release form and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
  7. Severability: If any portion of this waiver is found to be void or unenforceable, the remaining document shall remain in full force and effect.
  8. Acknowledgment of State Law: This waiver shall be governed by and interpreted in accordance with the laws of the State of Rhode Island.

Terms and Conditions for the Olive Oil Times Education Lab Sommelier Certification Program

1. Introduction: These terms and conditions apply to participants enrolled in the Olive Oil Times Education Lab Sommelier Certification Program ("the Program") offered by Olive Oil Times LLC. By enrolling in the Program, participants agree to these terms.

2. Program Participation: Participants are expected to engage fully in the Program, which may include, but is not limited to, attending sessions, completing assignments, and participating in assessments.

3. Merit-Based Certification

a. Issuance of Certificate: The Program offers a Certificate of Completion ("Certificate") to participants who successfully meet the established criteria. The decision to award the Certificate is merit-based, contingent upon the participant's performance and achievement throughout the Program.

b. Criteria for Success: The specific criteria for successful completion and eligibility for receiving the Certificate will be communicated to the participants at the start of the Program. These criteria may include, but are not limited to, attendance, assignment completion, exam scores, and practical evaluations.

c. No Guarantee of Certification: Enrollment in the Program does not guarantee the issuance of a Certificate. The Certificate is awarded solely based on merit and the participant's fulfillment of the prescribed criteria.

4. Assessment and Evaluation: Participants will be assessed and evaluated based on objective criteria. The Program reserves the right to establish and modify these criteria as deemed necessary for maintaining the integrity and standard of the Program.

5. Non-Discrimination: The Program is committed to non-discrimination in the assessment and awarding of the Certificate. All evaluations and decisions will be made based on merit and in accordance with the established criteria.

6. Changes to Terms: Olive Oil Times LLC reserves the right to modify these terms and conditions at any time. Changes will be communicated to participants in a timely manner.

7. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the State of Rhode Island.

8. Acknowledgment: By enrolling in the Program, participants acknowledge that they have read, understood, and agree to these terms and conditions.
